Terms and Conditions of SMS price alerts

  1. You agree that by opting into SMS price alerts you will be bound by these terms and conditions as well as the general terms and conditions (including any supplemental terms) that apply to your Account. Capitalised terms and expressions used in these Service Terms shall have the same meaning as in Our Terms unless specified otherwise.
  2. This service is offered by FOREX.com (“FOREX.com”; “we”, “our” or “us”), a registered trademark of GAIN Capital UK Limited.
  3. Subject to paragraphs below, to be eligible to take part you must:
    • be over eighteen (18) years of age
    • be based in the USA
    Anyone who meets all of the criteria above shall be deemed a “Qualifying Applicant”.
  4. We will not charge you to receive any SMS messages via this service but depending on your mobile contract you may be charged by your network provider. This situation is uncommon but we advise that you check with your network provider before opting into this service. FOREX.com will not accept any liability for SMS costs you may incur from your network provider as a result of using this service.
  5. SMS deliverability cannot be guaranteed and you therefore should not use or rely on this service as your sole method of monitoring positions/markets.
  6. Without prejudice to the generality of these Service Terms, we shall have the sole discretion to determine your eligibility under these Service Terms, including, without limitation, whether or not you are a Qualifying Applicant. We have the right not to accept a Qualifying Applicant as a Client for any reason or without reason as we shall determine in our sole discretion.
  7. Qualifying Applicants should read these Service Terms carefully, as well as Our Terms and the risk warnings https://www.forex.com/en-us/terms-and-policies/disclosures-and-risk-warning/ Under no circumstances will we be liable for any losses that Qualifying Applicants may incur as a result of trading on their Account(s) in connection with receiving or not receiving an SMS alert.
  8. We reserve the right at our sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process, the operation of the service, or breaches the service Terms or Our Terms.
  9. We reserve the right to alter, amend or terminate this Service, or any aspect of it, at any time and without prior notice, including limiting the amount of texts a client can receive. We may make changes to these Service Terms and will notify you of these changes by posting the modified terms on our website. We recommend you revisit these Service Terms regularly, and by your continued use of our services you accept any such modified terms.
  10. Any dispute or situation not covered by these Terms will be resolved by our management in a manner it deems to be the fairest to all concerned, and that decision shall be final and/or binding on all entrants. No correspondence will be entered into.
  11. If these Service Terms are translated into a language other than English, then the English version of the Service Terms shall prevail where there is an inconsistency.
  12. If any term of these Service Terms is found to be illegal, invalid or unenforceable under any applicable law, such term shall, insofar as it is severable from the remaining terms, be deemed omitted from these Service Terms and shall in no way affect the legality, validity or enforceability of the remaining terms.
  13. These Service Terms will be governed by the laws of the State of New York and the State and federal courts located in the Borough of Manhattan, State of New York shall have exclusive jurisdiction over any matter or disputes arising from this service or these Service Terms.
